1. Introduction and Acceptance
These Terms of Use ("Terms") govern your access to and use of the Total Sumum web application ("Service"), operated by SEBA Educational Technologies ("we", "us", or "our"). By accessing or using the Service, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy.
If you are under the age of 14 (or under 16 where applicable under national law), your parent or legal guardian must read and accept these Terms on your behalf before you use the Service. Schools and teachers accepting these Terms on behalf of students represent that they have the authority to do so and that appropriate parental consents have been obtained in accordance with applicable law.
If you do not agree to these Terms, you must not use the Service.
2. Eligibility and Age Requirements
The Service is designed as an educational mathematics platform primarily for students in primary and secondary education (approximately ages 8–16). In accordance with Article 7 of the Organic Law 3/2018 (LOPDGDD) and Article 8 of the EU General Data Protection Regulation (GDPR 2016/679), the minimum age to create a personal profile and provide personal data is 14 years in Spain. Users aged 13 or under require verifiable parental or guardian consent before any personal data is collected.
For users located in jurisdictions where the Children's Online Privacy Protection Act (COPPA, 15 U.S.C. §6501 et seq.) applies, we do not knowingly collect personal information from children under 13 without verifiable parental consent. If you are a parent or guardian and believe your child under 13 has provided personal data without your consent, please contact us immediately at [email protected].
Schools and educational institutions may use the Service on behalf of students under the applicable age thresholds provided that: (a) the school has obtained the necessary parental consents; (b) the school acts as the data controller for student data; and (c) the school has entered into a Data Processing Agreement with us where required.
3. User Profiles and Account Responsibility
The Service uses a local profile system stored in your browser's localStorage. No account registration or email address is required for standard use. You are responsible for maintaining the confidentiality of your profile data and for all activities that occur under your profile.
You agree to: (a) provide accurate and truthful information when creating your profile; (b) not impersonate any other person or entity; (c) not use the Service for any unlawful purpose; and (d) notify us immediately if you suspect any unauthorised use of your profile.
We reserve the right to suspend or terminate access to the Service for any user who violates these Terms.
4. Licence to Use the Service
Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable licence to access and use the Service for personal, non-commercial educational purposes. This licence does not include the right to: (a) reproduce, distribute, or publicly display any content from the Service; (b) modify, adapt, or create derivative works; (c) reverse engineer, decompile, or disassemble any part of the Service; or (d) use the Service for commercial purposes without our express written consent.
All intellectual property rights in the Service, including but not limited to software, design, graphics, game mechanics, and educational content, remain the exclusive property of SEBA Educational Technologies or its licensors.
5. Acceptable Use
You agree not to use the Service to: (a) violate any applicable local, national, or international law or regulation; (b) transmit any unsolicited or unauthorised advertising or promotional material; (c) attempt to gain unauthorised access to any part of the Service or its related systems; (d) interfere with or disrupt the integrity or performance of the Service; (e) engage in any conduct that restricts or inhibits anyone's use or enjoyment of the Service; or (f) use automated tools, bots, or scripts to interact with the Service in a manner not intended by us.
The Competition Mode is designed for supervised classroom use. Teachers and hosts are responsible for ensuring that the competition environment is appropriate and that participants' data is handled in accordance with applicable law.
6. Subscriptions and Payments
Certain features of the Service are available only through a paid subscription. Subscription plans, pricing, and billing terms are set out on our Pricing page. All prices are displayed inclusive of applicable VAT where required by EU law (Council Directive 2006/112/EC).
Monthly subscriptions are billed on a recurring basis. Annual subscriptions are billed once per year. You may cancel your subscription at any time through your account settings or by contacting us. Cancellation takes effect at the end of the current billing period; no refunds are issued for partial periods unless required by applicable consumer protection law, including the EU Consumer Rights Directive (2011/83/EU) and Spanish Royal Legislative Decree 1/2007.
School and classroom licences are subject to separate pricing and terms agreed at the time of purchase. Discount codes issued through the school programme are subject to the terms stated at the time of issuance and may not be combined with other offers.
7. Disclaimers and Limitation of Liability
The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or free of viruses or other harmful components.
To the maximum extent permitted by applicable law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising out of or in connection with your use of the Service. Our total liability to you for any claim arising out of or relating to these Terms or the Service shall not exceed the amount paid by you for the Service in the twelve months preceding the claim.
Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited under applicable law, including the rights of consumers under Spanish Royal Legislative Decree 1/2007 and EU consumer protection law.
8. Educational Content and Curriculum Alignment
The Service is designed to support the mathematics curriculum as defined by the Catalan Department of Education under Decret 175/2022 (LOMLOE) and related national and international educational frameworks. However, we do not guarantee that use of the Service will result in any particular educational outcome, grade improvement, or curriculum compliance.
Teachers and schools are solely responsible for determining whether the Service is appropriate for their students and curriculum requirements. The LOMLOE alignment information provided within the Service is for guidance only and does not constitute an official endorsement by the Catalan Department of Education or any other governmental body.
9. Termination
We may suspend or terminate your access to the Service at any time, with or without notice, if we believe you have violated these Terms or for any other reason at our sole discretion. Upon termination, your right to use the Service will immediately cease.
You may stop using the Service at any time. If you wish to delete your locally stored profile data, you may do so through your browser's storage settings or through the profile reset function within the Service.
10. Governing Law and Dispute Resolution
These Terms are governed by and construed in accordance with the laws of Spain, specifically the laws of Catalonia where applicable, without regard to conflict of law principles. The application of the United Nations Convention on Contracts for the International Sale of Goods is expressly excluded.
Any dispute arising out of or in connection with these Terms that cannot be resolved amicably shall be submitted to the exclusive jurisdiction of the courts of Barcelona, Spain, except where mandatory consumer protection law in your country of residence requires otherwise.

11. Changes to These Terms
We reserve the right to modify these Terms at any time. We will notify users of material changes by updating the "Last Updated" date at the top of this page and, where appropriate, by displaying a notice within the Service. Your continued use of the Service after any changes constitutes your acceptance of the revised Terms.
